Background Information:
Since 2004, UNDP and its partners have supported the Sierra Leonean
National Electoral Commission (NEC) to implement a strategic planning and
reform process, as well as prepare for and administer the 2012 election – the
country's second national election since the end of the 10-year civil war in
2002, and the first without the supervision and major logistical support of the
international community and UN peacekeepers. With the successful conduct of
these elections Sierra Leone has made important gains in the consolidation of
its post-conflict democracy and towards self-sufficient administration of its
own elections.
Following the successful conclusion of the 2012 elections, UNDP’s Support
to the Electoral Cycle in Sierra Leone
2011 – 2014 Programme continues to support the sustainability of know-how
and the development of long-term capacities of the National Electoral
Commission (NEC), including voter registration. To this end, the Programme will
provide assistance to the National Registration Secretariat (NRS) to harmonize
its national civil registry with NEC’s voter database, as well as other agency
databases, so that NEC could receive a voters register from the national civil
registry, thereby reducing the cost of voter registration and ensuring
harmonization of government registries. Under the Outcome of Strengthening
Civil Register to support NEC with a technically sound, credible and
sustainable Voter Register, at this stage, UNDP is seeking the services ofa Civil Registry Data Protection Legal Expert
with knowledge of voter registration and electoral affairs for the Programme.
Under the guidance and the direct supervision of the Chief Technical Advisor
(CTA) of the Support to the Electoral Cycle in Sierra Leone 2011 – 2014 Programme,
the Civil Registry Data Protection Legal Expert will assist NRS in reviewing
existing legal instruments with regards to the civil registration and support
NRS in development of a single legal framework governing all aspects of
integrated civil registration system.
Impact of Results
NRS, NEC and the Ministry of Internal Affairs benefits from UNDP legal
technical assistance and resultant legal framework will provide legal basis for
the new integrated National Civil Registry. NEC is able to receive regularly
updated voter register from the NRS. NEC’s voter registration is sustainable,
cost-effective, and integrated with the civil registry.
Duties and Responsibilities
Summary of key functions:
Working under the supervision of the Chief Technical Advisor, and in
partnership with the NRS, the Civil Registry Data Protection Legal Expert will:

Undertake review of legal
instruments, if any, concerning citizen’s rights and data protection and
production of a draft legal framework pertaining to data protection and its
usage;

Assist NRS and Ministry of
Interior in drafting a Bill on
intergraded national civil registry for the parliament;
·
Work with programme’s Civil
Registration Coordinator to ensure support to NRS is well coordinated;
Deliverables/Final Products Expected:
This assignment is to be completed within 65 working days. The main outputs
of the work will result in:
A draft legal framework pertaining
to data protection and its usage in accordance with the policy paper approved
by the cabinet;
Draft Bill on an intergraded
national civil registry for the parliament in accordance with the policy paper
approved by the cabinet;
Note: Given the complexities
involved in assignment of this nature key functions and deliverables will be
thoroughly discussed with the successful candidates. This job description will
be revised, if necessary, and deliverables will be agreed upon in the first
week of the assignment.

Technical Support:
The suitable candidate for this
consultancy shall have extensive experience in civil registration. Good
knowledge of information systems software such as MS Office Suite.
Planning and Management:
The expert needs to demonstrate a
proven record in the field of coordination, with experience in facilitating the
work of missions and task forces. Work experience in post-conflict contexts is
necessary.
Communication:
The expert will have written and
oral fluency in English.
Teamwork:
Ability to establish and maintain
good working relations with colleagues in multi-cultural environment.
Required Skills and Experience
Education:
An advanced degree (Masters) in
Law.
Experience:
·
8 years or more of
functionally-related professional legal advisory experience;
·
Proven track record of working
with Electoral Management Bodies (EMBs);
·
Excellent analytical,
communication, writing and presentation skills;
·
Previous work experience in
Sub-Saharan Africa an advantage;
·
The post requires considerable
cultural and political sensitivity and an ability to meet deadlines.
Language:
Excellent written and oral
communication skills in English;
Duration of the consultancy
The tasks are expected to take 65
working days to complete;
Payment Modalities
Payment to the consultant will be
made on monthly basis upon certification of satisfactory completion by the
Chief Technical Advisor of the Programme.
Evaluation of Criteria and Weighting
The expert will be evaluated against a combination of technical and
financial criteria. Maximum score is 100% out of a total score for technical
criteria equals 70% and 30% for financial criteria.
The technical evaluation will include the following:
Background and minimum
educational qualification as defined above-10%;
Practical previous experience
relevant to the TOR - 30%;
Substantial professional
knowledge and experience in legal domain -50%;
English language fluency -10%.
