Background Information:
Group Legal is responsible for providing
strategic legal advice to enable BHP Billiton to achieve its commercial
objectives and manage legal risk in compliance with applicable laws and
consistent with the BHP Billiton Charter.
Our team of Anti-Corruption & Trade lawyers
within Group Legal provides specialist advice on laws that represent critical
legal and reputational risks to our business.
The team's primary focus is advising the business on international
anti-corruption laws and trade sanctions and providing strategic legal support
to our anti-corruption compliance program.
We are now looking for a Specialist
Anti-Corruption & Trade to assist the team in providing this advice and
support.
KEY ACCOUNTABILITIES
Conform
with the BHP Billiton Charter, the BHP Billiton Group Level Documents, Code of
Business Conduct and relevant statutory obligations
Have an
overriding commitment to health, safety, environmental responsibility and
sustainable development
Working with a range of stakeholders, your responsibilities
will include assisting the Anti-Corruption & Trade team to:

Provide
legal advice to compliance teams, Group Legal and relevant teams within the
Business in relation to anti-corruption issues
·
Provide
guidance to the Business on management of corruption risk and the embedding of
anti-corruption policies and procedures.
·
Provide
legal advice on acquisitions, divestments and joint ventures and other specific
challenges which require management of corruption risks, including assisting
with mitigation measures such as appropriate counterparty due diligence and
anti-corruption clauses
·
Conduct
legally-privileged investigations on compliance-related issues, providing
recommendations for control enhancements and disciplinary action where
appropriate;
·
Assist
the Managers Compliance to perform anti-corruption risk assessments and
anti-corruption training with at-risk teams
·
Engage
with external stakeholders to communicate and promote anti-corruption
compliance in the mining/resources industry and BHP Billiton's compliance
program;
·
Develop
strategic improvements to enhance the design and effectiveness of the
compliance program as well as develop and maintain training/guidance materials.
·
Provide
legal advice on trade sanctions, export controls, AML and anti-boycott. Develop
and/or participate in training to cover these areas as required.
SKILLS
AND EXPERIENCE
In addition to your legal experience (+2 years
PQE) you will need to have interest in international anti-corruption and trade
laws and a clear understanding of why compliance is critical to BHP
Billiton. Experience in these areas of
law is not essential, but a desire to learn and develop experience is
expected. Exposure to regulatory
investigations or litigation would also be preferred.
To be successful in this role, you will need to
draw on previous experience in clearly communicating legal concepts to business
stakeholders, applying legal concepts to a diverse range of scenarios and
undertaking investigations to determine the facts which are relevant to the
analysis of legal issues. We are also
looking for you to display strong verbal and written communication skills to
gain agreement across a wide group of stakeholders.
You will clearly need to be degree qualified
(Law), have admission to practice in Australia and have a willingness to
travel.
